Laws like these that encompass images produced without depictions of real minors might run counter to the Supreme Court’s Ashcroft v. Free Speech Coalition ruling. That case, New York v. Ferber, effectively allowed the federal government and all 50 states to criminalize traditional child sexual abuse material. But a subsequent case, Ashcroft v. Free Speech Coalition from 2002, might complicate efforts to criminalize AI-generated child sexual abuse material. In that case, the court struck down a law that prohibited computer-generated child pornography, effectively rendering it legal. “AI-generated child sexual abuse material causes horrific harm, not only to those who might see it child porn but to those survivors who are repeatedly victimised every time images and videos of their abuse are mercilessly exploited for the twisted enjoyment of predators online.” Child pornography is illegal in most countries (187 out of 195 countries are illegal), but there is substantial variation in definitions, categories, penalties, and interpretations of laws.

Some people accidentally find sexual images of children and are curious or aroused by them.
Many of these images are taken at home in children’s bedrooms or in family bathrooms when the child is alone or with another child such as a sibling or friend. The laws in each state vary, but in some cases children can be charged criminally for sexual behaviors with other children. Depending on the severity of the activity, the behavior could fall under the legal definitions of abuse and a child could be charged. A young person may be asked to send photos or videos of themselves to a ‘friend’ that they might have met online. These photos and videos may then be sent to others and/or used to exploit that child. Alternatively, they may also be used as a threat or manipulation tool to get a young person to participate in sexual or illegal activities. Westpac was accused of failing to monitor $11 billion worth of suspicious transactions, including those to the Philippines suspected to be for child sexual exploitation. For decades, law enforcement agencies have worked with major tech companies to identify and remove this kind of material from the web, and to prosecute those who create or circulate it.
But BBC News tested the site’s “new exceptionally effective” system in April. While a fake ID did not work, we were able to set up an OnlyFans account for a 17-year-old by using her 26-year-old sister’s passport. Leah used most of the money to buy presents for her boyfriend, including more than £1,000 on designer clothes. Caitlyn says she doesn’t approve of her daughter using the site, but can see why people go on it, given how much money can be made. Leah had “big issues” growing up and missed a lot of education, Caitlyn says.
Earlier this year, Philippine police set up a new anti-child abuse centre in the country’s capital, Manila, to fight the growing problem, helped by funding and training from British and Australian police. “All he wanted from me is to pass videos to him of children having sex. It didn’t matter to him where this took place.” Many of those buying the films specify what they want done to the children, with the resulting film then either live-streamed or posted online to the abuser, who watches it from their home.
